California law guarantees non-exempt employees overtime wages for all hours worked over 8 hours in a day and 40 hours in a week. These wages are generally 1.5 times your regular rate of pay and sometimes double that rate of pay. However, employers often underpay for overtime hours worked where:

  • An employer wrongfully classifies an employee as exempt from overtime;
  • An employee’s wage statement fails to distinguish between regular hours and overtime hours worked;
  • An employee is paid split-shift premiums; or
  • An employee regularly performs extra work off the clock.
  • An employee is salaried or earns non-discretionary bonuses.
