Class Action Meal and Rest Breaks Private Attorneys General Act (PAGA) Wage and Hour Law

Plaintiff was a driver for defendant Greatwide Dedicated Transport II (“Greatwide”). He has filed a wage and hour class action on behalf of 75 truck drivers (“drivers”) who are current and former employees of Greatwide.

On behalf of the putative class, Plaintiff sought payments for missed meal periods, unreimbursed business expenses, statutory and civil penalties, interest, and attorneys’ fees and costs under Labor Code sections 201-203, 226, 226.3, 226.7, 512 and 2802, among others, and IWC Wage Order No. 9-2001 (“Wage Order 9”). Plaintiff also sought relief on behalf of himself and the Class pursuant to Business and Professions Code sections 17200 et seq., including restitution and disgorgement of all benefits Greatwide has enjoyed from its unlawful practices. Plaintiff also sought penalties pursuant to the California Private Attorneys General Act (“PAGA”), Labor Code sections 2698 et seq.
